Challenger: Tehno Consulting & Design S.R.L

This reference is made to the competitive process “RFP/ QCBS / Ref: WAS-B05/CF MUNICIPAL UTILITY TECHNICAL ASSISTANCE TO AGUAS DE SANTIAGO” initiated on September 11, 2013. The reference is further made to RFP Section I: ITC, Clause 9. Bid Challenge System, which sets the rules that govern to review any complaint submitted by a bidder.

This notice is to provide information on the final Decision taken by MCA CV II Review Panel regarding the Protest filed by the Challenger, Tehno Consulting & Design S.R.L, to all bidders that participated in the referenced tender launched by Millennium Challenge Account – Cabo Verde II, as well to the Millennium Challenge Corporation, MCC. 

Pursuant to Section I: ITC, Clause 9. Bid Challenge System of the RFP, the MCA CV II Review Panel has reviewed the protest filed on June 24, 2014.

And on July 4, 2014 MCA CV II Review Panel issued a notice in relation to the Protest filed by the referenced Challenger referenced above which was sent electronically to the affected bidder, explaining and detailing the circumstances under which this procurement was conducted.

It was concluded that the evaluation process was conducted with the accuracy and transparency in compliance with the MCC PPG Clause P1.B.1.3 (a), always applying the MCC Program Procurement Principles in all procurement processes of the Compact; therefore, taken into consideration the forgoing, the bid challenge submitted by the Firm Tehno Consulting & Design S.R.L is denied.

The period for each Protest Party to file an Appeal, which concludes within 5 working days of the date the Consultant learned or should have learned of an adverse decision by the MCA CV II or other basis of appeal to MCC, has expired. Thus, the referenced Procurement process shall resume and proceed accordingly.
